Allowed to go over Credit Limit

I recently gave 2 separate credit card details to my electrician to settle his account, unfortunately he took the whole payment off one credit card. The bank allowed this payment to go through, pushing my credit card £3500 over the agreed limit. They are now saying that I have 1 month in which to bring my card back to the agreed credit limit. They also tried to charge me £12 per month for being over my limit. I have now had this stopped as they agreed they should have declined the 2nd payment. Can they insist that payment being made or do I have the right to pay as and when I can afford it. So long as I make the minimum payments.

  • You need to bring it back within the limit. You were very lucky they refunded the overlimit fee, as it's your responsibility to keep within the limit.

    It will also be reflecting negatively on your credit report. so bring it back down as soon as you can.

    Can the electrician do a refund and then take the right payment from the right card?

    Unless your instructions weren't clear it's his mistake and he needs to resolve it and refund any charges.

    The longer you leave it the worst your credit file is getting.

    Agreed, if you told the electrician to take it off two cards then the merchant has effectively taken the money fraudulently off the one card. Surely a partial chargeback would be possible?

  • I didn't allow myself to go over the limit. I had arranged to stay well within my limit. The bank authorised the payment that pushed me over the limit.
  • Surely this is a banking error. I am not trying to get out of paying the amount, I just need time to repay it and bring the card back down to the agreed credit limit.

    Surely you realise that the "Credit limit" is simply a figure that you are required to stay under, its not a figure that the bank will automatically refuse payments once you hit it, although the bank may decide to decline payments once you are a certain percentage over your credit limit.

    This is why there is a charge of £12 per month for being over your limit.

    If you just gave you electrician 2 CCs numbers with no specific instructions to "Take £xx from this card and £yy from this card" then you can't really complain.

    It's not a banking error.

    You issue is with the person who entered the transaction, the Bank have acted on that and have determined that it's acceptable to allow the transaction.

    go back to the person who put the transaction through and get them to do a partial refund on the card you are over on and to charge the other one.

    stop messing about with the bank.
