House Extension - neighbour's complaint about devaluing her house

    That was my thinking too, but in her letter she says that if we can not comply by her request, she will take legal action!

    Let her take the legal action. Don't be scared off by the threat. My feeling is that she won't take any action at all and is just trying to scare you - just a form of bullying.

    Did you serve a party wall notice and reach an agreement on the award?

    Did she object at the planning stage and not get anywhere with the planners? Poss. the neighbour has been contacted by 'no win, no fee' chancers who look for PP grants and then make trouble.

    Yes, we served part wall notice. No problems there. She stated her complaints before the planning permission was granted, so I guess the council did not consider her issues major.

    You know, you are absolutely right, she is a bully. Only writing letters and posting them through the door even when it is clear we are at home.

  • I generally agree with what others have said.

    However it is just possible that there is a restrictive covenant preventing alterations/extensions. Even if there is the neighbour would have to prove that she had the benefit of it, which is not necessarily the case.

    if she was the neighbour from hell, she could claim damage to her property, which while unjustified could tie you up with expensive party wall surveyors.

    Clearly any objections she lodged with the planning department were not valid. Ignore her, she's away with the fairies.

    I can take legal action against you too, if I liked. But its quite clear that neither she nor I have any legitimate grounds to do so, and would be thrown out.

    Yes, this. You had proper planning permission granted, which had already taken her gripes into consideration. Just ignore the windbag.

    You could point out to her that engaging a sol will need to be notified when she sells and this will affect her. Otherwise keep letters, or just put them back into her letters box marked return to sender!
