I think I would be calling the fraud department of my bank to get advice on what's going on and why "you" received the letter although it was your address that received the eltter so to speak. Without knowing why this has happened I wouldn't assume anyone is liable for anything or that I'm somehow owed money when I may not have suffered any financial loss or suffered in any other way other than to have opened a letter which caused concern and could be easily explained and sorted out.
Why on earth would you want to call the fraud department? Customer services should be a first port of call - in writing if you are so inclined to want to pursue it to the nth degree.
I was involved in a case like this once when I worked in banking, this happened to a customer who then took her complaint to the IOC. She dropped it after being advised that they get in the region of 100 instances per year advised to them of similar situations occurring which they put down to machine error. The person whose statements she received received a small amount of compensation for breach of confidentiality - the IOC weren't interested in taking it further.Gwlad heb iaith, gwlad heb galon0 -

Well thanks for the replies. I contacted my local branch who were extremely blasé about the situation and said send it back and just write no longer at this address, despite the fact that the person has never resided at this address. When i questioned what assurances i would get that no-one had my details i was told "in this day and age nothing is that secure".. to which i was gobsmacked and she began to try making it sound better by saying "well its as secure as it can be." She also refused to talk to me about the account in question because it wasn't mine, i had to laugh that they can send me the statement and all its details but refuse to even say where the person had opened the account and when. In the end i called and spoke to customer services manager who apologised and told me that the person has been using my address since 2006 and running up large overdrafts, the only reason i haven't recieved any notification of this is because the person had selected paper-free statements but by law they have to notify me of charges via letter. The manager said that they would investigate further and ensure that my details were not used by the customer again. Does make you wonder doesn't it!! Oh and as for the compensation, this is something i hadn't even thought of but my Mum (who is compensation queen) said i should try for it, personally i didn't think so and thats why i asked. Never mind hopefully its all over and done with and they track the sods real address!!I LOVE MSE! :money:0

Quite understandably you feel anxious about this situation, i would feel the same way myself!
Reading your post, personally speaking, it seems that you have not got any satifaction from your bank, i would'nt mess around.

In a nutshell this should have not happened, when they took out the account there must have been offical checks made, and some verification on the address that was shown. I went through hell trying to open an account a few years ago, with my bank. Sounds a bit iffy too me Laneyboo.
This bank are obviously very lax in the data security.. i'm sorry too say!

I spoke to The Ombusman a few years ago, they are extremely helpful, if there is not a case they will tell you right away, if there is a case, more power too you!
You could always threaten to Bank with The Ombusman, that'll move them. LOL

It is a Criminal Offence not to give Banks your current address, so either way Laneyboo you are right to follow this up!0 -

I actually heard it on the radio, it was on the news about 2 weeks ago!
It was news too me before then, i had no idea? I guess they are changing things all the time!
I don't understand what's behind it all, something about banks chasing customers and certain individuals who do not notify the banks of change of circumstances I.E Address.
For the record i have heard it mentioned in my local Halifax a few times also!

The banks (as their latest money grabbing scheme) have announced they are going to charge you £30 if you don't tell them you have changed your address.0 -
Having read all the above I would be quite sure that the op's details have not been disclosed to anyone else so the breach of the Data Protection Act involves the other customer not the OP. With regard to compensation the rule of thumb is, you should not be put out of pocket by an error made by the bank. I would think they should cover stamps, phone calls etc but we'd not be talking a large amount.0
