Driver reversed into me from driveway

    am i allowed to name insurance companies I'll give the first letters mine is DL his is T

    DL told me his insurance company have sent a letter claiming they want to settle for 50/50

    no i never reported it to the police as I thought foolishly and naively that it was straight forward, he said he was in a rush but i knew where he lived to get the details for his insurance from ( took a few visits to the house of course to find them eventually in ) but never dreamed that he would turn and say i was partly to blame doh!!!

    I've only ever had one other accident in all the 22 years i've been driving and that was someone going into the back of me at a roundabout and I had witnesses so was really easy to sort out!!

    Well assuming that you have completed your claim form correctly, DL don't have to be brain of Britain to work out that you were in no way at fault.

    So their response to the TP's insurers should be "your'e having a laugh". The fact that your car is damaged on the side should confirm that the TP reversed into you.

    In many accidents especially where liability is disputed, the two drivers accident report forms bear no resemblance to each other i relation to what actually happened

    I am aware of that. The insurance assessor will look at the damage to both vehicles and use 'evidence' that to compare the continuity with the driver's reports. If the TP's vehicle is damaged at the rear and the OP's is damaged on the side, then it's fairly clear who hit who I would of thought.

    It's highly unlikely that the OP was travelling side-wards when the collision occurred.

    You were in a queue of traffic on the road, he pulled out of his driveway and banged into the middle of you - how did he get away if you were in a queue of traffic?
    how could there be no witnesses in a queue of traffic?

    Each Insurer will use their own assessor to survey the damage to their own customers vehicle. Although increasingly the Insurers approved garages will just upload images of the damage for the Insurers to view.

    If the OP manages to convince the other drivers Insurers they may be liable they may send their own engineer out.

    It's possible for an engineer to inspect both vehicles if the claim is disputed but this costs additional money and would require cooperation from both drivers and is fairly rare
  • I'm staggered that you've been driving a damaged car for 10 months, surprised it hasn't started to rust yet. Not to mention any safety implications.

    Your insurers cannot progress this as you haven't claimed anything off them.

    There are often opposing stories about how collisions occur.

    Unless you make a claim this won't go further via your own insurer. (Unless the third party makes a claim)

    Another option is to see if a claim handler will take this over for you and pursue the third party insurer.

    he drove off as he pulled out of his drive in the opposite direction to which i was travelling ( if you can picture that and it makes sense ) I then pulled over, i was at the back of the queue of traffic so there was no one behind me and when the traffic lights changed all the other cars infront of me drove off, i very much doubt they would have seen the accident as it was dark and probably everyone else was minding their own business in front as he he was pulling out he didn't exactly hit me with a massive bang

    the dent is just a dent which means that it is drivable, it would cost me less than my insurance excess to get it fixed by a friend but he insisted on going through the insurance, he seems to be claiming for damage to his rear bumper ( when i took the photo you would have trouble seeing any damage infact probably a little scratch thats it!! )
  • Have you got a link to google maps or a screen shot of the aerial view. I can't wrap my head round it.
