ok,for some reason the other site who helps folk dont seem to want to help me ? so here i go again,,,took the wrap for my mate,,he parked in a p&d,unaware had to pay,,most of you will know where this was.so to prevent further stress etc,the follow up pcns have come to me but the surname is incorrect,,eg.bolt,,but addressed to colt for arguements sake,thus changing the whole surname,,the solicitors are doing their usual,by saying pay up or we will send you letter before action etc etc,,,all i want to know is,,if they actually do this,and i dont turn up in court,will it be a valid judgement against me,as incorrect name???? i honestly dont mind going to court if i have to,just want to know the answer,,much appreciated.

I don't really know but Daisy who posts on here will probably be able to respond to you better. I did see a response I think yesterday or the day before from her about them using a middle name as a surname and you shouldn't rely on that.

Hopefully she will see this and respond.

By the way its not likely they are acting for the parking company so its not likely to go to court

A CCJ is an attachment to persons, it is only as valid as your name.
If they obtain a CCJ in the name of Fred Blogs when you are in fact john smith, then Fred blogs has a CCJ not John Smith.

guys,thanks for your replies,spacey,just to clarify,using my example,,if the real name of the person is,,,say,,mr r topping,,but the letter states,,,mr r wopping,then i need not attend court if requested? many thanks stroma also for your response.

Just be careful that other communication doesn't have the correct name.

guys dad,i take your point,,but still looking for clarification,as in your e.g the surname is in fact correct,,in my e.g. the surname is completely different,hence,,,bolt,sent as colt or topping sent as wopping,,i have had 4 letters now,none in correct name,once again just looking for guidance,,if they do go to court,will/can i get fined,if in incorrect name,,i will go if need be,it really doesnt bother me,but if they are up the creek without a paddle because of incorrect name,then i will just sit back and do nothing.thanks.

If the name on the court papers is wrong, they will have a valid CCJ, for the person named on the CCJ, if that is not you, tough for them.
Your name is as is on your Birth certificate, or deed poll.

In a perfect world I'd agree with you but care is required. Just download your credit record and it can be surprising how there are entries for names that don't match your own but are very close. It shouldn't be possible but it does often happen.

I agree, and as an ex-Bank lending team Manager myself, if I saw a very similar named CCJ I would be asking whether it's one and the same person.

Bondy lad, have you actually got a LBA or Letter before Claim yet? If so then you should respond to it as per zzzLazyDaisy's thread on LBCCCs.

Its a dodgy ploy once had an entry on my credit reference file with an "also previously known as", with my christian names reversed.
Took an age to have it corrected, its quite easy proving who you are, rather more difficult proving who you're not!
