POPLA Bad Decision

I have just had an email from POPLA to let me know that they have decided to reject my appeal ... I paid for 3 hrs parking but was parked for 3 hrs and 4 mins ... however ParkingEye told POPLA that I had only paid for 1 hour - I am unable to prove it is a lie as I no longer have the ticket! Am I therefore bound by law to pay the charge just because POPLA say I should???

    This will be another case of where you havent used the winning points in popla appeals, i assume you didnt get advice before hand?

    Can you post up the decision so people know how not to appeal (sorry to sound harsh but it will stop others making a bad decision)

    So depending on what was in your appeal your title could actually be quite misleading

    No you are not bound by law to pay at all. But Parking eye are pretty litigious

  • Hmmm .... just been reviewing Rachel's previous posts. She came here asking for help AFTER appealing to Parking Eye but never mentioned getting a POPLA code and if she did never asking for assistance.

    I may be wrong but I smell a plant !

    Its not the end of the world, Instead of offering more advice, I would suggest that you take a read of the following article in the Guardian

    paying attention to the final paragraph ( ive addded the bold)
    If you appeal and Popla does not uphold your complaint, its decision is not binding on you. You can either pay up or, if you are sure of your case, wait to see if you are taken to court. If Popla finds in your favour the parking company is required by the BPA code of practice to rescind the charge.
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

  • Given I'm clearly wrong ( apologies ) please could you post up the POPLA appeal you sent ? It will help us see why it failed and use it for future reference.
  • To KirbyInFurness - I did get advice from this site months ago which is where i heard of POPLA and appealed accordingly, didn't realise i could;ve had someone steer me through it. I gave POPLA my version of events and ParkingEye gave theirs and POPLA have taken their word over mine. I don't know how to prove that they're not being truthful as i no longer have my ticket. I paid for 3 hrs parking but PE told them i only paid for 1 and i was parked for 3 hrs and 4 mins. How many people keep tickets on the off-chance they'll get a charge weeks after?

    PS.. I assume a "Plant" is a bogus post ... I wish!!!
  • It's not a case of being truthful.

    It's a case of using the right terms to win. Truthfulness and the ticket are completely irrelevent as are the events.
    Could you post up the decision pls.

    Next time you will know that it doesn't matter what happened on the day
