Evening all,
Since march i've been in the process of trying to get back my charges which total £3069 with £478.01 of interest too.

I've sent off all the letters and have been refunded £853 so far.

Next stop was "money claims on line" I got a bit confused about how to put in the interest, seen as now they had given some of the money back as a gesture of goodwill :mad: so am i right in thinking to put it down as£3069-£853= £2216 with the interest still at £478.01 .. i'm hoping thats right:confused:

Today i went to the citizens advice bureau,just to see if i had all the info i would need. they say i might be better taking off taking my claim to the finanical ombudsman as the courts are throwing some claims out!! and they say i should get a specialist to help too.

I was thinking about phoning to my local courts tomorrow to see if they could help me on the right path.
I'm a little unsure on what to do now....any tips anyone

    For the Money Claim Online form, put the individual charges into Martin's interest calculator, add the interest and then simply deduct the part payment from the total.

    As we have won 10,000+ cases, but only lost 4 and have 20 in Hull that might be struck out but are being challenged, it is impossible for me to comment on the Citizens Advice Bureau's "advice" without breaching forum etiquette. Basically, they said to get a solicitor to refer your claim to the Financial Ombudsman for you.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. However, you cannot refer your claim to the Financial Ombudsman until you have been dealing with the bank for 40 days. They also cannot force the bank to pay up, set the level of the settlement or award interest like a court. Despite this, their success rate is good. Being financial experts, they can also threaten to ask the bank some very awkward questions. If the Financial Ombudsman is unsuccessful, you can still take the bank to court (but not vice versa).

    Stephen, thanks for your advice.
    I think i've got the interest bit worked out now...lol.
    As for the courts i'm unsure which to use MCOL or local,everyone else here seems to use MCOL. I assume they are the same? The fees are affordable at the moment too. This whole process scares the hell out of me, but i've got to keep trying.

    It won't matter for the end result but MCOL is a bit easier to use and you can check the status of your claim at any time and do everything online, including filing for judgement by default.

    And forget what the CAB said. You do NOT need to get a specialist to help you, they just cost money whereas this forum gives you the same help for free.

    If you read the bank charges article - it goes through the issues between courts and FOS. I wouldn't be too quick to write off the FOS route. I think for many people it is preferable to the courts - my article takes you through how to choose :)

    I think i'll use the courts route,but i'd like to read the article too.
