Lied to by DEA

I have been claiming DLA for the last 5 years but this was after a break of over 15 years
I had an accident 23 years ago that left me almost in a poor-state and slowly I have recovered over the years - at the time of the accident, I claimed DLA when I was out of work for three years and was told by my DEA at the time that since I was now working - I could no longer claim DLA - This incorrect advice could have caused me financial hardship and I am now wondering if there was any procedure to claim 15 years of back-DLA ?

    DLA is being phased out. You can no longer claim it. You will have to claim PIP instead.

    What type of DLA were you receiving and at what rate? As you were recovering did they decide you no longer qualified as you were better?

    They will not backdate DLA for 15 years.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    I was wrong - just checked 13 years !!
    I was claiming DLA from 1992 - 95 and then started working again - at this point, I was told that since I was bringing in money - I could no longer claim DLA - Which was incorrect
    I put in a new claim in 2008 and have been claiming care component ever since !!

    Who told you this? was it an official body in writing?
    How did you close your claim?

    From what I remember - it was closed for me by the DEA
  • Too late to appeal. You should have appealed with your new claim in 2008.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    if the Disability and Care's Service did make a mistake then there is a way to complain and sometimes they will make a special payment.

    However, I think that you would have some 'evidence' to show that someone/some department closed down your claim without your authority and you were told the incorrect information.

    I also think that the length of time since this happened would go against you. Not knowing the 'rules' is not a good enough reason to complain, particularly after such a long time.

    If you feel that you have a good reason for not complaining before and could show that you have 'suffered' in some way there may be a very small chance that they would make a special payment.

    To be honest, the odds are against it given the very large time gap, but I do not know all your circumstances so if you think you have a case then follow the information in the link.

    DEA - Disability Employment Advisor
    Who was supposed to support me both in employment and unemployment.....
    but clearly had no clue !!
