Help !! Rugby pitch being built 5 metres behind property

I am looking for some advice with regards to a new buildleasehold property I have recently purchased.



I purchased theproperty in April 2013. It was built in Feb 2013. I used a lawyer asrecommended by the developer to purchase the property.



I have recently found out that a rugby pitch is being built5 metres behind the property. The planning permission for this was obtainedbefore I purchased the property. Neither my solicitor nor the developer informed meof this during the buying process. Am I entitled to any compensation? NaturallyI am concerned about the noise and lack of privacy that will result from havinga rugby pitch just outside my back garden. I would never have purchased thisproperty if I had known about the plans for the rugby pitch. Interestingly neither of my neighbours knew about the rugby pitch being built. Building has just started.

I have contacted the solicitor and they have said that they accept no liability as they have followed conveyancing guidelines. They did admit they did not know about the rugby pitch and said that they would send me a report but they have not. I am not sure where (if I have anywhere?) to turn now.

Do standard searches not reveal planning permissions granted nearby? Too late for you, but never ever use a solicitor recommended by the vendor or their representative (EA).

Why are you all being so harsh? Isn't this exactly the kind of thing that is supposed to become known about during searches? The searches you pay your solicitor to do?

Yep, potentially 2 hours of noise on a Saturday afternoon against nose 24/7 from flats or similar.

At least you know you will have a green space at the end of your garden for the foreseeable future.

The rugby pitch is much better than a number of alternatives, but you are right, I would expect it to come up in the searches. Having said that, I seem to remember when I discussed with our solicitor he said the searches actually have a very limited range (although 5 metres isn't exactly far away!!)

We backed onto private fields that were used for football practice and matches on a Sunday, we loved it. The men used to take their deck chairs out onto the field and watch the match.

The only downside was the bad language :eek:

I think you need to consider the scale of this, if they are starting work on an 80 thousand capacity rugby stadium, or even something a bit smaller, with a capacity for a few thousand then yes the developer should definitely have made you aware of it, and your solicitor probably should have highlighted from the local searches.
But if on the other hand it's just something like a park land sports pitch then a big open green space is probably one of the better things you can have behind your property.

Are they building a club house too? How far away is this? The rugby club I play for rent the club house as a venue most weekend nights and some mid week. Could be noisy. The actual matches themselves is only a couple of hours on Saturday so shouldn't be too bad. Is much rather that than a football pitch! But would also be very annoyed at the solicitor you pay them an awful lot of money to check these things for you.
