    As regards the genuine customer exemption, I think it could be argued that having a secret term in the contract between PE and the retailer but not telling those who would suffer by not knowing about it, is unlawful. A 'misleading omission' as defined (I think) in the UTCCR 1999 when I checked it out for this thread:

    No-one has tested this yet but I think a poster who fancied a real fight-back, could try a small claim against PPC and retailer (jointly and severally liable for damages and distress) for not divulging and communicating this important fact; i.e. for genuine customers to know that they are exempt and wouldn't have to pay.

    After all, neither party has any excuse not to communicate it somewhere seeing as the PPCs have signage with other terms on and the retailers have receipts, signs, a CS desk, a shop window...etc.

    You have read my mind somewhat with what I was after. I spoke to the assistant to the director responsible for the retail parks. Told her I had some questions and issues that I'd like to raise with them regarding hidden, unfair clauses or at least arrangements.

    Then a few observations specifically about my case, then some general points of criticism.

    If I do get around to it, you are welcome to have a look over it before I send it.
