Liability for calls made on lost mobile

i recently lost an O2 mobile while abroad in spain & did not realise it had gone missing until approx 8 hours later.

i cancelled it with O2 but when i got back to the UK & looked at my bill the phone had been in constant use up until the time it was cancelled to the same 3 spanish mobile phone numbers

O2 say i am completely liable for the full £350 bill & are unwilling to follow up any fraud investigation

do i have any comeback ?

I'm not sure but I would imagine you are liable until you report it stolen
  • Hi Muppetduke,

    SNAP!!!

I lost my O2 mobile while in Spain, Barcelona and am facing 700 quids worth of calls inc VAT!

I called up O2 and they said the same thing to me throwing the liability clause of the contract in my face. I told them that there is no way I could pay that in one go and studied their finance options. I love the way they have the funds to upkeep a department to ensure we pay these stolen phone bills but not to ensure phone theft doesn't incur these ridiculous bills.

Then they drop the bomb. Not only am I going to pay this ammount (for which I begrudgingly accept legal liability) but I won't be allowed to make calls from my phone until I pay the full amount. I'm fuming that I'm being treated as irresponsible when I am the victim in this.

Anyway, if you are up for it, let's join forces. I propose we find others in the same predicament and share tips. I'm sending my phone bill to Spanish police hopefully to aid them find the source of this crime (a long shot I know).

Keep me posted how it goes for you.

    Good luck,

    ben

Unfortunately your liable for calls until you report it lost/stolen, when abroad roaming calls will cost you so much more, so it's always good to take/have customer services numbers with you. There's a brief list below of CS numbers to call from a landline, most of the numbers will be accessible when dialing from abroad.

    o2 - 0870 586 0860

    Orange - 07973 100 150

    Tesco mobile - 0845 301 4455

    t-mobile - 07953 966 150

    3 - 0870 7330 333

    Virgin mobile - 0845 6000 789

    Vodafone - 07836 191 191

If you have mobile phone insurance this generally covers for this check the small print...
