HELP! Anglian Water Problems

Morning,

We moved into a new house last year. We phoned Anglian Water and set up the new address. At the time they seemed to be struggling with finding our new address but they assured everything was ok. We ploughed on as most people do assuming everything was alright.

Today we got a letter from Anglian Water saying that we were in default, and pointing to reminders that have been sent out. This was news to us. We had never received any demands for money from Anglian Water, and I told the customer services advisor that that was the case.

SHe said adamantly that they'd been sent out, that Rosendales Debt Collectors had been in touch with us to collect the money, and to top it all off, said that CCJ proceedings had been sent to us in January.

We had received nothing from them!

I informed them that we hadn't heard anything from them. The advisor said she'd go and have a quick look at it and she put me on hold for a few minutes. She then came back on and said that she was going to investigate further because they had problems sending things to us.

Now I know its slack of us not checking our account regularly to check how it was going (Something we'll make sure we do!) but where do we stand? I'm fairly sure that we'll be able to pay the money off we owe them, but are CCJ or any credit score problems over-turnable if, as it seems, they haven't been mailing us any bills?

  • Just realised - there's a town that's spelt the same way as our home town elsewhere in the country, and therefore after looking at the CCJ against me, its actually at the same address, but in the different town. How does this all work?
  • Not sure how to get off the bad debtors list, but you can definitely apply to the County Court for the judgement to be struck out. Get on HMCS and find the form, complete it and pay a fee. You can do a money claim online, but this one maybe not.

    If the judgement is struck out, perhaps the procedure to get off the naughty list will be easier.

    Sorry - that should read '...judgement to be set aside'.
  • Thanks for all the information and help guys.

    I phoned the court this morning. They said if it was AW's mistake, and they admit that, then it would be cheaper, easier and quicker for me if they applied for it to be set aside.

    Thankfully, AW agreed, and have put the wheels in motion. They said that any record of it will be wiped from my records within 6 weeks.

    Just out of interest - because the CCJ was against an address in Leicestershire that isn't connected to me, does that mean it won't show up on my records. Just wondering, as since the CCJ has been given to me in Feb, I have got a new phone contract and applied for a personal loan...
