Help! EE Store lost my Drivers license!

    but it would not have been binned when you were there. Eventually they may call the police to remove you, but then you just inform the police they have either lost your DL or one of their staff have taken it and i dare say this would be worse for the store than you.
  • Ok, what I have been told today is that the last manager who left on Friday will have binned it because there is a 24hour policy to keep it. That manager has left now. The new manager doesn't know anything, he's only started and is not in. She, the girl, that I made the purchase from, says it would have been binned to get rid of me but admitted she doesn't know for sure.

    Does that sound like complete fiction to you?

    Convenient that the manager has left and no evidence that it has been destroyed and no link to anyone working there.

    They still would not spend more than a minute looking for it.

    Are they allow to bin it? Should it only be returned to DVLA?
  • It should have been returned to the DVLA - I would be speaking to someone higher up the command chain in head office now as if that is policy to throw away things after 24hrs it should be done properly - which could mean it might still be in the store. (unless this has been weeks we're talking about) It certainly shouldn't have been thrown in general rubbish - not being a sensitive document.

    Surely the store have a duty of care towards lost items, as well as an additional duty to keep your private data confidential. If they've thrown it in the bin, that's a massive breach of the DPA right there. They accepted that duty of care from the second the advisor took the license until she handed if back. As it was never handed back, they have breached data protection be either losing it or chucking it in with general waste.

    You may wish to go to the information commissioner for a full investigation.

    Also, as your address was on the license, I see no reason why they wouldn't just post it back instead of binning it.
  • It is your driving licence, not theirs, it is not their fault that you lost it it is yours. If you can not take care of important documents, then you should not be in possession of them. Blame yourself not everyone else.

    Maybe, but EE asked for the DL most likely to verify who the OP was. once they did this they should of passed this back to the OP, so while in EE possession it is them that should have a duty of care towards the document.

    A mobile phone account has been opened in my name. Reported to provider and action fraud. EE Head Office have done nothing yet but need to chase up.

    It was only a matter of time.

    Any advice? Other then reporting to provider and police.

    Keep a record of any and all costs you incur sorting this mess out, then send EE a letter before action claiming the amount back, as they were responsible for taking care of your licence and handing it back to you which they failed to do.

    I would be sending a recorded delivery letter NOW, if it were me, telling them I hold them entirely responsible for not ensuring that the licence got back to you and that they have failed in their duty of care and that I would be claiming compensation for any losses incurred as a result of their failure to take their responsiblities seriously.
