In USA, 16mb data used but data roaming is off!

OK. Worked out whats happened.
Before I left:-
1. Ensured data roaming was off.
When I got here:-
1. Turned on mobile.
2. Got status of not active for some reason.
3. Checked data roaming is still off.
So now a few days later, I've power cycled phone and this time it seems to have registered with a network. I've got texts coming through inc 2 from O2 warning me I've spent £20 and then £40.
Now when I go to use internet it tells me data roaming is switched off - as it should.
Checking data usage for last few days its all background data from facebook etc.
So it looks like before I rebooted today:-
1. Data roaming off setting on phone was ignored and background data was used somehow.
2. Phone had not registed with usa network for some reason (hence no texts) but it did use the data service.
Not good. I'm guessing O2 are going to say not their problem that phone was not working correctly or that phone picked up data?0 -

If O2 supplied you with the phone (in addition to the service), then O2 is liable for any billing discrepancy caused by a defect in the phone (software or otherwise). This is one of the very few advantages of acquiring a phone from the network. The supply of both the phone and the service is governed by the Supply of Goods and Services Act 1982.0
