  • Maybe if you could summarise the statement of reason then some of those well up on the law could advise.
Play nice  Just because I am paranoid doesn't mean they are not out to get me.:j
  • My family and I are furious. I want what I am entitled to. I have got an illness that has blighted mine and my family's lives.
Well you should get all you are entitled to if you are incabple of work. Not sure what you are asking? If you are severely disabled
  • Hi again. Sorry for confusing you. I need to know what I can do and what point of law I can look for. Thanks Confuseddot, I'll work out how I can summarise the main points.

It's quite simple. Post the 'Statement of reasons' here. Without it we cannot dissect the reasons why you were refused. We can all make 101 reasons up why that may be but without the actual reasons they have given you we're just taking blind stabs.

And summarising may not be enough - to quote a relevant judgement:
The duty to apply the relevant law carries with it a duty to make findings of fact sufficient to enable them to decide which descriptors are met and which are not. If a tribunal were to overlook an activity in the work capability assessment, they would not have applied the law correctly. But, provided the reader can understand (a) why the tribunal awarded no points, or why they awarded the points they did, for each of the activities and (b) whether they applied the law correctly in doing so, the requirement of an adequate statement of reasons is satisfied.

Just summarising 'they said I could do X' - is not helpful - and is not useful in most cases without the detailed reasoning.

Seems actually revealing the reasons why he was refused has stuffed him, both here and with DWP. Oh well....
  • "Deserve"? Seriously?!

    I loved that one too!!
