    The flue exits from the extension wall that this new extension abuts??

    That is a problem if thats the case, but if it is, it should not have been up to the boundary anyway.

    I am of course surmising, can't think of any other reason.:eek::eek:

    they say to us 'oh by the way we have instructed a party wall surveyer and you will receieve their letter next week..."

    I did wonder when you said you'd "offered a party wall agreement" and then gone ahead anyway if that could create problems. AFAIK, if the neighbour refuses to sign a served notice than after 14 days you are automatically deemed to be 'in dispute' and an independent 3rd party should have been engaged to draw up the Party Wall Award.

    Their failure to respond at the time has not reduced their rights to redress under the PW Act

    With your project manager walking off site too, it might be a wee while before you are out of the ground. just saying.

    In the same way that they can't complain about your side the answer is no, you can't.

    I do have to say this is really escalating, the fact that an agreement between the 2 of you couldn't be arrived at without a formal party wall agreement, (it is perfectly acceptable to do this via a letter on a personal basis), means it is now going to cost you, the only winners will be the scavengers that tout this service, check out other threads on here about the issues.

    Keep it to the book, looks like they are out to cause you as much financial harm as possible, and remember, "revenge is a dish best served cold";);)

    How far (in metres) are the footings for your extension from their adjoining structure which I presume will be their extension?

    i think I get your drift.

    Something in the party wall act prevents your foundation base undercutting an angle of 45deg from their foundation base, check it out.

    IE, is there a level difference?
