Item returned to Amazon but seller is keeping part of my refund!!!!!!!!

I bought an item for £42.90 on Amazon, free p&p skincare item.
I changed my mind and returned this in original packaging, unopened.
I requested my refund and I only received £35. I asked seller for the rest back and I quote 'I'm allowed to keep £7.90 for my time, postage and packing.'
I raised this with Amazon but they said I'm not covered under the A-Z guarantee. Is this not stealing?!
I paid £2.60 to return it, so in buying an item online that when it arrived I changed my mind and returned I'm now over £10 down of my own money.
I'm certain I am entitled to the full refund but I'm not getting anywhere! Any suggestions? Under distance selling regulations I'm entitled to my full refund surely? Her and Amazon are not budging!

Did amazon tell you why you're not covered under A-Z guarantee?
Tbh the only real course of action is an LBA. If that didnt get a result I wouldnt bother with small claims due to the sums involved - the judge likely wouldnt be impressed.
Was it perhaps a private sale? Or was the seller definitely a business? You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Also, how long was there between you receiving the item and you notifying the seller you wanted to return?0

This is the crucial question.0 -
Is there anything in the sellers ad about restocking fee if you change your mind ?This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

If it's a business and you cancelled within 7 working days (subject to getting this info buy durable means or it is 3 months and 7 days) then you should receive the full refund. If it was out side this period then they can set the terms for a refund which would make it legal to deduct part or the refund.
Thats the law, on the other side of the fence the way they look at it is you have cost them time and money with your ordering relying on DSR to protect you.
The smaller one man band businesses say no, they can't afford to take a hit on timewasters and know Amazon, Ebay etc will not force them to refund postage charges.
Stick to the bigger retailers if you want to rely on DSR.0 -

i was just asking no need to get your knickers in a twist !This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
I didn't see anyone getting their knickers in a twist.
They were just stating a fact?????make the most of it, we are only here for the weekend.
and we will never, ever return.0 -

It took 3 weeks for the item to arrive, so I didn't receive it within 7 days....
If its within dsr, how on earth and who do I go to, to be able to claim my money back?
Amazon said I'm not under their guarantee because I did receive the item I ordered and it wasnt faulty.
Seems grossly unfair!0
