mandatory interview VS Job interview.

need some advice for my BIL.

made redundant 2 months ago now recieves JSA cont.based.

landed job interview that clashed with mandatory interview, called JCP who told him tough we cant re arrange (or rather wont) and its mandatory so if you miss it for what ever reason we will stop your money.

so he his now put off going to the interview just incase he doesnt get the job and has no money after because he didnt turn up to the mandatory interview.

i thought, that the JCP cannot interfere with your obligations to seek work. I.E they cannot tell you you have to miss a Job interview for job center mandatory interview i thought the JCP would actually encourage him to go the job interview not discourage him.

i need something to help him see they cant sanction him for missing a mandatory because of a JOB interview.

    Go to the mandatory jobcentre interview. It is not the way to look for work but the hassle of getting your benefits back after a sanction is applied is very hard. He will have to rearrange the job interview. If the employer is understanding if they'll change it and if they won't allow the time to be rearranged then just find another job. Stupid I know....but do you really want the hassle.

    I would ask confirmation from them that they are indeed instructing him not to go to the job interview so he can go to the mandatory one and that this will not result in being penalised.

    I find it absolutely amazing that they would say something like this, so certainly wouldn't trust what someone on the other line of the phone who might not have a clue telling me that this is the case.

    i wouldnt.

    last thing you want is to sanctioned for cancelling the job interview on careless advice hence why i ask here is there anything i could pass to him so he can fire off on the fire the exact regulation code to them. im not familliar with JSA regulation or case law.

    he asked for confirmation letter, they dont do those on request apparently.

    he called again (just to see if theres a confliction of advice), they told him, they could impose sanctions either way failure to turn upto both or one or the other, but did say she couldnt see a DM upholding the sanction appeal nor a appeals tribunal upholding the sanction, she said he must give 24 working hours notice pre cancellation to a mandatory and it must be a good reason, and this is where the sanction reason could lay behind what they said but didnt explain it well to him.

    as per phoning to re arrange an interview if i was an employer asking for more time for an interview doesnt show punctuality or dedication i would withdraw the offer and hand it to someone who will turn up!

    This seems reasonable and sensible having to produce proof.

    this has my head spining as i cant find in the new regulations anything relating to WFI's and short notice job interviews, it states you must be available for one but not what if i have a short notice job interview the same time as a WFI JCP meeting.

    3 Where none of the above apply, the DM may take into account all the circumstances of the claimant’s case, including in particular
    1.
    whether the claimant misunderstood what they had to do because of language, learning or literacy difficulties, or because they were misled
    2.
    whether they (or someone they care for) were attending a medical or dental appointment which it would have been unreasonable to expect them to rearrange
    3.
    any transport difficulties
    4.
    any religious reasons why they could not participate
    5.
    whether they were attending a job interview.

    Unless something has changed?
  • I had a job interview and I was given a mandatory interview at the same time, I said - and I had a copy of the email with the interview details in it - that I had a really important interview that I had a decent chance of getting, but the woman simply said her appointment could not be moved.

    So I ended up rearranging the job interview for silly o'clock early in the morning, did a 3 hour round trip there and got back just in time for my mandatory interview. I was then made to wait ONE AND A HALF HOURS as the guy before me was late, and then still had his meeting which mainly consisted of (as I was sat behind him fuming) being asked why it took him an hour to walk to the JCP when he lived five minutes away. The advisor announced that she would not be sanctioning him, but not to do it again.

    I was furious by the time she got to see me but couldn't say anything as if I'd been sanctioned that would have been the last straw.

    The Job Centre DO NOT sanction its the decision maker at the DWP who does

    The JC would report him for not attending and then in turn he would get a letter saying there was a doubt and he would be given a chance to prove he went to an interview, so can send a photo copy of the letter with all the contact details etc to them at the DWP as proof

    They can not sanction people for going to an job interview!
