Thomson Airways Two Year Appeal

So it seems that having lost and been shot down in flames at the Cambridge court in an attempt to limit claims to two years or less, Thomson Airways' toys are very much out of their pram. So much so they have decided to appeal the decision.

This thread is for remarks on this matter complete with a prediction poll on the appeal outcome...

  • I'm so pleased to hear that Thomson lost at court. Thomson have been trying to pull all sorts of tricks with my delay claim. They have tried to tell me about the Montreal Convention (what the hell is that to do with Europe)? Also now they are telling me they are taking advice from "a pre-eminent aviation QC". This QC is quoting Domestic Law. What's that to do with my claim? I have now taken my claim to the CAA. I will advise everybody to NEVER fly Thomson. My husband I were delayed 24 hrs on departure from Gatwick and then 24 hrs on our return to Gatwick. This was a long haul flight so it will be for the maximum compensation. I think they are a nasty airline, we were even told lies at Gatwick and told to go home as there no rooms at hotels nearby and return the next day. Funny we got one easy! They just wanted us to pay out for more petrol rather than them paying for hotel. Well eventually we did get reimbursed but it took a while! Has anybody ever received compensation from Thomson?

    Sadly the CAA are about as much use as a sack of spuds with flight delay claims. All they can do is offer an opinion rather than force the airline to pay.

    Quite a few people have been successful, but only after starting legal action. Check out the FAQ in the first few posts https://forums.moneysavingexpert.com/discussion/4384699 and start a claim!

    If you think the Montreal Convention and Domestic Law have nothing to do with your claim then you have a steep learning curve ahead of you. I'd suggest you get reading all posts on the Thomson thread and all posts on the Thomson Claim 2 years limit to claim thread.
