Should either yourself or your girlfriend have a sudden restoration of memory in the next couple of weeks and realise it was her driving then you, as the registered keeper, should inform PCM of this by sending them her name and an address they can write to her at. She will then get the chance to appeal. ;)

No she won't - do not do this because with PCM I very much suspect there will have been a windscreen ticket at first.

Naming the driver is only advisable if there was never a ticket to 'the driver' in the first place (i.e. an ANPR issued ticket which went straight to the keeper).

I say carry on ignoring but check for an actual Letter before Claim or court papers of course, which would need a response if they send you them.

  • OK the threatening letters from Newlyn have now escalated to, "you have 14 days before proceedings in the county court will be initiated"
Am I right in still ignoring everything other than actual court papers?

    Thanks in advance.

Well Newlyn can't initiate court proceedings, all they can do is hand it back for PCM or a solicitor acting for PCM to initiate a claim.

Never seen a PCM claim maybe they unlike others realise that claims cost them more then they recover!

Same as advice here just minutes ago:

Yep, ignore it unless you get a Letter before Claim from the PPC or solicitor.

Current advice is to appeal and win at POPLA, not ignore nowadays but too late for this one, you are treating it with the old-school ignore advice so stick with it.

  • Received a letter mid October saying the file had been passed back to PCM who will proceed with court action.

That was the last thing I heard, which was over three months ago now so it looks like it may have died a natural death.

thank you to all who contributed.

Keep ALL the paperwork though...did you not realise a small claim can potentially be raised within six YEARS?!
