PCM / newlyn - reassurance?

Looking at the excellent advice on here I thought it best I start my own case thread:

Private car park managed by PCM with the usual signage and warnings, car park is for local residents who have permits for individual bays.
In June 2013 My vehicle was parked in an area (not anyones bay) with no ground markings or hatchings, and my vehicle did not impede anyone or restrict anyone's access.

Rightly or wrongly I have been ignoring the letters from PCM & I have now received an letter from newlyn requesting an increased amount, which I intend to ignore.

Was I right to ignore this in the first place? and am I now doing the right thing by ignoring the latest letters?

Many thanks in advance for any advice?

  • I assuming that you are the registered keeper and that you were driving. If so then ignore is the only course of action now open to you. I don't recall that PCM have ever done court so you should be fine.

    If your WEREN'T the driver then it's a whole different story.

    Yes I am the registered keeper but my memory eludes me, I was probably the one who parked the vehicle, but it could have been my girlfriend who is a resident and has a permit for her own bay,

    It might be worth checking with your g/f to see if she can remember who was driving. If it was her it can put a different slant on things.

    But we are not suggesting fabricating any truths here - perhaps the names Chris Huhne and Vicky Price are a reminder of how things can seriously blow up in faces ..... with a very nasty bang!

    A case of riding out the storm of any further (increasingly) threatening letters which can safely be ignored (they have no direct legal standing) until they either die the death or court papers arrive.

    Do NOT ignore court papers, come back quickly on this thread if any arrive.

    Should either yourself or your girlfriend have a sudden restoration of memory in the next couple of weeks and realise it was her driving then you, as the registered keeper, should inform PCM of this by sending them her name and an address they can write to her at. She will then get the chance to appeal. ;)

    I take it there is no value in phoning newlyn and simply saying I have absolutely no intention of paying??

    Absolutely NOT.

    You will never 'win' in this situation. They are dealing with that sort of 'up yours' phone call every minute of every day (it's their job) and will be better versed than you - sorry, I know your basic instinct is to do this, but it has no advantages, but it does have at least three disadvantages.

    1. It costs you a phone call

    2. It wastes 10 minutes of your life

    3. It marks you up as someone who may be a good candidate to pursue harder (hooked fish).

    Resist all temptation :)

    No, NEVER ignore from the outset. Very briefly the advice is :

    1. Await the Notice to Keeper
    2. Appeal to the Parking Company
    3. Appeal to POPLA
