The 38Mbps service is supposed to be capped at that so they've screwedup.

FTTC offers higher upstreams than any cable product and suffers far less jitter but cable can still beat FTTC on highest headline speed if you care to pay for the 120/12 service.

I like cable as I don't need a physical phone line with it.

I have infinity 2 which should be up to 76mb (but the website does say 38mbs) but I know I'm on the last cab and last dp off the exchange, so was pleased with 30mbs, it does fluctuate mid 20s upwards, the upload remains above 5mbs, I don't need the phone line either but paid upfront for 12 monthsand circumstances allowed me to have infinity for nowt, so I'm saving at least £4.90 a month soon to be £6.75.

That is completely irrelevant to the speed you get. Each cabinet has it's own fibre back to the exchange (there is a clue in what the service is called - Fibre To The Cabinet). What matters is the length and quality of your twisted pair cable to the cabinet.
