Not happy but am!

Hi,

My husband got a PPI claim back from Abbey with an offer which is great from the time of signing the contract with the credit card to when we cancelled it in 2011 (and this would pay off the overdraft with a different bank) but abbey want to put the whole lot against the debt of £6k he has with them, which is currently within a debt management plan.
I know I have managed to regain money from other debtors returned directly to me despite being in a DMP so why can't we fight this.... I am so peeved off they have "trapped us". Is there anything we can do?

  • The £6k debt was run up with Santander which is who gave us the PPI and are now refunding us. I read somewhere they aren't allowed to keep the 8% interest so can I still go back to them with that and allow them to put the rest again the debt?

    Is the debt associated with the credit card that had the PPI?

    I ask a simple question on a forum I don't expect judgement nor crap from other people, I just would like a simple answer as provided in your first email.
    None of us here know (or care) what you spend your money on. You asked if there was any way to "fight" the Bank's intention to off set the redress awarded against the money you still owe them .

    The answer is in the link I provided and it's that the Bank are perfectly within their rights to off set.

    Sorry if this comes across as "rude".

  • I think we can stop with this now. It's getting boring and they aren't rants, just plain facts - I am in shock. I expect people on forums who are in similar situations to be helpful.

    It's your opinion, so hardly facts. I haven't seen anyone being Judgemental. As I said, no one cares why you are in a DMP. It's got nothing to do with the position you find yourself in.

  • Probably no...I know they need to protect their interests. I do have a payment in place though which we are keeping to etc .

    I only asked the question because one other company which I put into a DMP gave me the money directly that was all.

    The link I provided earlier indicates that Banks are fully within their rights to off set debt which is in arrears or has defaulted. Some banks will take full advantage of this right, others may be more generous.
