Some companies may refund to you. Others may not.
The rules do allow the lender to offset against the debt if it is in arrears, defaulted or been subject to a write off. However, only that debt. Not others. Lorettac, I would'nt listen to these lot on here as they are rude, judgemental and dont give you advise just there very rude opinions. They have not got a clue what Banks decide etc. I would write or e-mail to the Chief Executive Officer of the Bank in question and explain your situation to them or seek FOS advice. I would join another Forum called Legal Beagles which I am with and they are very polite, helpful and give great advice from there legal experts in this field. These on here are a load of T....S especially Moneyinepitude. Sorry but they are.0

I am pretty new on here as one or two of you might know. I myself find this forum extremely useful as a means of gauging and comparing the experiences of others with those that I am currently undergoing. And a lot of the regular contributors are very knowledgable and offer excellent and (largely) unbiased factual advice.
Over the years I have frequented many forums across a great many subjects and social spectrums - and I consider myself experienced in conversing on forums and I have the obligatory wide shoulders needed sometimes to deal with what comes my way during forum interaction. However, while I have found on here that the content and quality of the advice given is nearly always excellent, the presentation and delivery often leaves a little to be desired.
All too often, new posters come on here and leave offended, not by what they are told, but how they are told. And for the majority of examples, I completely agree with them. Have some of you not asked yourselves why this is?
Now you can all get defensive and tell me the oft-used superficial defence that ppl usually don't like to be told bad news and if you dont tell them what they want to hear, they scream back that you're just being rude etc etc; but honestly - is that the case with EVERYONE?? I honestly don't think so.
Just in the last few days, I have seen at least half a dozen new posters looking for advice and guidance, only to become upset by the replies given. I myself experienced the very same at the very beginning, when I had the temerity to question the advice given by one of the old guard. As I said I have bigger shoulders and wont get offended by a bit of keyboard warrioring.
The regulars here (no names mentioned at all) have a responsibility - more than anybody here - to represent the integrity and credibility of the forum and site and I firmly believe that responsibility extends beyond the advice given. Otherwise you are almost certainly doing more harm than good. Firstly to the OP who might well disregard the advice ONLY because of delivery. Secondly, to the site and forum itself. Reputation and word of mouth is very powerful. And on this thread alone, the one message I have taken in is that elsewhere there is another similar forum that may offer me similarly valuable advice but in a way that is polite and respectful. Was that the intention of this thread?
I firmly believe there is a way of offering ANY and ALL advice in a way that does not leave the recipient feeling belittled, ignorant, humiliated or chastised. And if you are not able to do that, then maybe not to contribute is the way forward. Remember - a lot of you are used to "you". New posters are not - and again, I can see what some of the new posters are upset about. The advice is good - but its presentation sometimes makes me wince....
And calling each other names is hardly going to solve the problem either.0 -

I do not under any circumstances plan to not pay the debt back. In fact we have arrangements in place to pay them! so it's not a case of them not getting the money back...
