    Ah, in that case, I guess it would have to be mentioned in the will itself to ensure the instruction is followed.

    Yes I think so. The drawing up of new wills though is expensive so I am wondering if we still can get access to the free wills service that is usually done in October, I wonder too if the Trust forms part of the will or whether it is a separate document, do you know ?

    Sorry, I genuinely don't know. Someone who does will come along though, I'm sure.

    You could always write a codicil with these changes in it but change the executor to your daughter then only she could sell the house anyway. Personally I would use the free will service and set it up with trusts in place assuming this would be covered under the free will situation

    If I can get into a free will service I will ask them their advice on the best route to go. I didn't think executors could refuse to dispose of property under their control, I thought executors were purely people in charge of distributing it strictly in accordance with the will, which according to my solicitor can be challenged in a court of law if only added under a codicil.

    I have just had a reply back from the "Will Service" and apparently they try to get different locations for each will campaign in March and October and have asked that I check in again on the next one when hopefully they may have some in my area. Luck of the draw I guess ! :(

    Most free wills offers are a way og getting their feet under the table and selling you something else such as a trust, or signing themselves up as executors.

    Why would any professional do all this work for nothing?

    As this service is offered through charities, and they request you donate to charity (although of course they can't force you to bequest out of your will), they hope you will leave something to charity. My sister used them and she does donate to charity and has left some money to them in her will, so it worked in her case. :) As to why solicitors themselves offer this service, I have no idea but perhaps someone on here who is a solicitor will tell us ;)
