Can I be sued for cutting down a tree in my own garden?

    Thanks for all your input - I'm being calm and sent a very nice letter stating the contents of my deeds. Hopefully they will realise their error and back down. I'll let you know of any progress.

    As we are all part of the same housing development (~15 years old), I'm suspecting all our title deeds will be very similar.

    I agree I should have checked for a TPO, but I relied on the (probably wrong assumption) they should tell me & allow me to object if someone want to protect a ugly tree on my land (that is potentially damaging my foundations).

    If it has been TPO'd they should post a notice to that effect on the tree if i recall correctly from my hazy memory of Planning Law lectures...

    my parents have a big cedar in our back garden which has a TPO and I'm sure there's no notice on it... (my mum would probably have grown something over it if there was..)

    They only need to put a notice on when it's designated - not keep one there permanently!
