Further to my previous letter of dd/mm/yy, I have been researching this matter and the following has come to my attention.
As I wrote previously, I believe that you have obtained my name and address as the keeper of the said vehicle under the provisions of the POFA 2012.
The said act has certain mandatory obligations imposed on parking companies and one of these is a strict timescale for PPCs to contact a keeper of a vehicle.
In the case of ANPR situations where vehicles did not receive a windscreen ticket, the timescale is 14 days from the day after the alleged contravention. This provision is so that the keeper is in a position to recall who was driving at that time.
You have failed to adhere to the legally required timescale and I, therefore, am not obligated to advise you who was driving and your right to transfer liability onto the keeper has been lost.
Under these circumstances, you are asked to cancel the ticket forthwith, or, if you really want to waste £27 and think you stand a chance at POPLA, by all means send me a POPLA code and we can go through the charade of you trying your luck when you know that you are bang to rights on this one.

Having sent these appeal on 10-9-13 I have heard nothing at all. Is this usual please0

Did you get proof of posting. PPCs have a habit of "losing" post, and claiming they never received your appeal. All lies, of course, but oh so convenient for them.
THe BPA Ltd Code of Practice says they should have acknowledged your appeal within 14 days, and made a decision within 35 (unless there are exceptional circumstances, which they should have told you about again within 35 days).
So, no, it's not usual. But it is common enough (see first paragraph). If you start to get debt collectors letters, then they are clearly going down the pretend-we-never-got-an-appeal route.
If you really want, you could tell them that, as you have heard nothing within 35 days of your appeal, the appeal is deemed to have been accepted, and you expect to hear nothing further from them or any debt collectors, save for confirmation of that acceptance.
You could also put in a complaing to the BPA Ltd about their non-compliance to the code of practice.0 -
Whoo hoo sent an email based on the above on Sunday evening (I didn't have proof of posting but of course did not say that). Just had an email confirming the charge is cancelled. Thanks all for advice0

Just to confirm this was VCS & Robin Hood Airport? It looks like VCS realise they are in deep trouble if they try pursuing a vehicle keeper for "Dropping Off/Picking up in restricted area" under POFA 2012 when (1) It's not parking & (2) It's not relevant land so are going to give in any time someone appeals. Sadly I suspect that they will still scam plenty of innocent motorists until someone who has paid up under false pretences takes them to court.0

Well done! Could you possibly show us a scan of the Notice to Keeper as we haven't seen this one from UKPPO recently and we could do with checking the wording on both sides please. I think you can post links now you are over 10 posts...if you have no scanner then a good photo on close-up, hosting on tinypic or photobucket would be really helpful (front & back but with car reg & PCN number & name/address covered.

They aren't quoting POFA at all so don't have any right to chase the keeper but this is worthy of a complaint to DVLA BPA Ltd & Trading Standards as they grossly mis-represent their case & try to wheedle & bully the name of the driverif you were not the driver at the time you should tell us the name and current postal address of the driver0
