This guidance suggests frugal_mike is correct, and I recall being told the same at uni. However I am unsure if there is case law to support the guidance, or whether it is still current?

Thanks for the link. Again nice to know I didn't completely make this up. It was easier to find evidence it was illegal in other countries (such as Australia) strangely. I've no idea if its still current, but I didn't see anything to contradict it.
