And if you have a slightly bald tyre or a broken headlight, legally you shouldn't be on the road either. Does that mean you can't claim of someone drives into the back of you? Yes you can make a claim. The accident wasn't caused by your daughter's lack of insurance, it was caused by the other driver's bad driving. Your daughter's insurance situation is a separate matter.

your insurance status has no effect on your ability to claim if you aren't at fault.

    How's the complaint going?

Thanks for that but I wouldn't know where to start, how do I go about claiming when I don't have an insurance company behind me?

The complaint is still on-going, they said they will write to me before 24th September with an update or full response.

You being uninsured doesn't affect you being able to claim off the liable third party.

In view of the injury you might consider using a claim handler/injury solicitor to deal with this for you
  • I've received a response from Tesco...."I confirm we requested proof of your NCD afer your policy was set up 3.4.13. We sent reminders on 1 and 13 May, each clearly outlining the consequences if this information was not provided. As this had still not been received by 20 May we confirmed we were cancelling your policy within 14 days and asked you to return your certificate. This period of notice was given in line with our polict terms and conditions and sent by post, not e-mail, to your home address. I am sorry to learn this notice was not received but I am unable to explain this as our records confirm the letter was sent to the address we have for you....I am not disputing this, I knew I received that letter BY POST and that's when I sent my proof off and when I didn't hear anything back I took it everything was ok. When I said this to their customer service department why did the tell me I set up an e-mail address and that is where everything would go to!! Surely they can't use 2 forms of communication when it suits them, if they can send a reminder about NCD by post why wouldn't the send something as important as a cancellation that way?

"When you contacted us to make a claim it was confirmed your policy had been cancelled. We referred to our underwriters and agreed to set up a new policy for you" (They didn't refer to anything, I was put straight through to sales) In order to arrange your new cover we had to state you had no cancelled policies as we could not quote otherwise due to a system restriction. They go on to apologies for the confusion in receiving 2 policies with different information on them and are unable to uphold my complaint and in future must advise any future insurance companies that I've had a policy cancelled.
  • So basically they wanted your NCB but you took too long sending it to them and they cancelled your policy.
