Another item not received!

Hi all,

I hope someone can help.

In short I bought an item off ebay in August which was never delivered to me. When we started looking into it RM had infact delivered it elsewhere - so it had a signature but not ours. RM have since confirmed that they have mis-delivered and to contact the sender and get her to claim.

Yesterday I opened a case, after nearly a month of messaging her and she has now turned unreasonable and said she will not refund me until she gets her refund from RM. So thats me now left without my item or refund when she knows damn well she will be getting a refund off RM as they stated it in their letter.

Once we have passed the 8 days of the case being opened can I then escalate it to ebay? They have all the information they need including a copy of the letter which ive uploaded through the message centre.

I have been more than patient and have gone above and beyond what I needed to do and now she is turning nasty!

Never had to do this before in 8 years of being on ebay. Think this will be my last transaction!

    Don't communicate any further with the seller, and escalate after 8 days.

  • Don't let it put you off - people can be rude sometimes but it won't stop you getting your money back. Like campdave says - escalate the case and include the letter you have from RM. Ignore the seller, it's not personal, it's just business.
  • Thanks PB, I know I shouldnt but I do take it personally!! I do feel bad for her but at the end of the day its RM that have failed us both and she is going to get her money back too.

    Will sit tight and let you know how I get on.

  • Just updating you all on the situation... not sure what happened to 'Buyer Protection' but Ebay have filed in favour of the seller because they have looked at the tracking information which says is was delivered. Is was delivered yes but not to us! They havent even looked at the letter we have attached from Royal Mail proving it wasnt delivered to us and was delivered elsewhere.

    DH going to ring and appeal at 9am when they open. Really disappointed with all this and still put off using ebay again.

  • I do sympathise, but seller protection is what has kicked in.

    The seller doesn't need a signature and the online status just needs to show it is delivered. So nothing else will change that, the seller will win.

    But, the appeal process should allow you to add further evidence that you didn't receive the item. Call them, explain in VERY simple terms as this is Manilla you are dealing with....! Ask them for an email or upload link to add the RM evidence.

    In my experience, you will win the appeal and EBay will reimburse you from their own funds.

    If you get Manilla, hang up and try again until you get through to Dublin.

    Make sure you mention the "money back guarantee" they've had plastered all over the site for the last few days.

    Manilla deal with ALL disputes in the resolution centre, not Dublin!
