P4Parking PCN and TNC Parking Services

I received a parking charge notice in May of £50 whilst parked in the visitors bay in a residential development in London when visiting a friend. I consider the charge unfair as there were no signs near the visitors bay regarding obtaining a permit from the porter (based within the development). All signs were posted on entrance to the residents car park and not by the visitors bays. I read through a few posts on here which advised to ignore the ticket until a Notice to Keeper is received.

Anyway, the ticket was served by P4Parking who then sent a Notice to Keeper (NTK) last month to the registered keeper, my dad (at a different address to me), after getting details from the DVLA saying that he had 14 days to make payment of £100 as the initial £50 wasn't paid. My dad was behind on his correspondance and notified me after the 14 days had elapsed. Nevertheless, I wanted to notify P4Parking that I was the driver and to provide my address, in order to avoid my dad receiving such letters. But nowhere on the NTK did it have the address or contact number for P4Parking so I submitted a query on their website, expecting a response within 24hrs as stated on their automated email. However, I didn't receive any reply.

In fact, my dad received 2 additional letters from TNC Parking Services saying that they were appointed as debt collectors on behalf of P4Parking to recover the unpaid charge and that the charge had gone up to £140 which now includes some admin charge. I phoned TNC and notified them that I was the driver and provided them my address. Now I have received a letter from TNC demanding payment.

How do I go about appealing? Do I need to contact P4Parking (I only have their email address as available on their website), or TNC Parking Services, or both?

    You need to appeal and ask for a POPLA code

    Can't believe they have no contact for appeal. If so it is non compliant with BPA requirements.

    Worth checking BPA Cop on their web site as their NTK may very well be non compliant elsewhere as well and that's a get out of jail card for you.

    I've checked the P4Parking website and nowhere on it does it say they are BPA Compliant. However, the letter that P4Parking sent to my dad has the BPA logo at the bottom, and a "BPA Approved Operator" logo.

    Strangely, I haven't received any letters from P4Parking directly to me - all I've received is a letter from TNC Parking Services stating that I should deal directly with TNC in terms of settlement/appeals.

    My plan of action is to contact TNC and inform them that I haven't received anything from P4Parking and I disagree with the PCN due to the reasons I stated previously. This should then allow them to issue a POPLA appeal code which I can take up with POPLA directly. I won't get in contact with P4Parking as they haven't sent any letters directly to me.

    Please let me know if this isn't quite correct.

    I'd suggest a slightly different approach with TNC. As they are acting as debt collectors you should tell them that you deny the debt and they should return it to their client P4Parking.

    I agree.

    The debt collector is not in a position to assess appeals or issue POPLA codes. You need to be dealing with the organ grinder's monkey, not the organ grinder's monkey's monkey :). (the organ grinder being the residential development's management company).

    You do need to get a letter off on your Dad's behalf stating that you were the driver and give them a serviceable address. This resets the clock and they will write to you as the driver, at which time the appeals process can also restart.

    I've checked their website and they are particularly 'shy' about any address. If I were you I'd contact the BPA stating the inability to contact them and ask them to provide you with a serviceable address for this outfit.

    Companies MUST show their company registration number and registered address on their web page. Not sure who "enforces" that, is it TS or Companies House, or some other body?

    Companies House enforce most of these requirements e.g. company registration number and registered address must appear on all communication. However TS should enforce the requirement that company registration number and registered address appear on all invoices e.g. PCNs.

    Of course they won't say if they are compliant or not ! I meant that if they don't follow the guidelines, then they are not able to charge you.

    Read section 20. This refers to POFA paragraphs 6(1) and either 8 or 9. This in turn tells you what the letter to keeper and PCN must contain. Check them out.

    Any failure to adhere to this renders th PCN invalid.

    That thread came to a grinding halt. I wonder if the OP on that thread actually followed Broadsword's advice - it seems to me to have been a real killer for the DVLA to deal with, pity there's no update.
