crew out of hours????

Can anyone give me advice on this one please.
A long haul crew member flying into India and then having 48 hours rest period (R & R)before forming part of crew on later flight back to uk falls foul of immigration law on arrival and is detained and deported therefore is unavailable to crew flight back. Good old Thomson don't get replacement out in time to prevent severe delay despite at least 6 flights LHR to BOM and onward to Goa which could have been utilised to get replacement in and negate delay. Eventual used our other good friends TC. So initial problem is not tech/mech it is admin and then when replacement arrives they need rest which makes our eventual departure 10+ hours late. They are trying EC. Would this even be EC?, I'd say visas and crew are inherent in airline ops. If yes though would it be on previous flight?, Would it be Out of Hours? In the spirit of regulation could I use C 294/10 Eglitis Ratnieks judgement which is cancellation although it does give the impression that airlines need to make provisions or should I stick to Wallentin 3rd question. Also does anyone know what minimum rest is on on long haul of 11hrs actual flying for cabin crew being flown in under this scenario or would it give Einstein a run for his money.

    If the facts are as stated, the only thing exceptional is the inadequacy of the airline concerned.
