BOI Bailiffs above the law

BOI bailiffs recently broke in my brothers house after he got into arrears with his mortage(he was not home at the time),they completetly cleared the house and took everything to the local tip.
This included belongings/paperwork/sentimental items belonging to other relatives.
We are gutted,by the time we heard about this it was to late to recover anything.quess they will get away with it as we cannot afford to take them to court.

    To aid us, perhaps you can explain how you know that it was a bailiff and that items were taken to a tip?

    Certainly sounds it. I have a close friend who used to work as a bailiff and they had a lot of rules to follow and they were all in it purely for the money - they wouldn't waste their time with something that couldn't earn them something. Clearing out a house and taking a load of stuff that they can't sell to a tip sounds like a massive waste of their time and quite unlikely.
    Common sense?...There's nothing common about sense!

    If the property was repossessed, it will only have been done by court order. The property would then have to be cleared to make it fit for resale. This isn't something that happens overnight.

    As for your thread title, no bailiffs are above the law of course, however a reputable bailiff knows precisely what they are allowed to do.

    It sounds more like the house was repossessed and then cleared at some point later.
    In which case there it is likely the period between it being repossessed and cleared would likely be weeks/months (I'm not sure, but I think they are meant to store stuff for a short while at least).

    As has been said Bailiffs won't take stuff to the tip, they'll try and auction it even if they'll only get pennies in the pound for it.
    They are also (from memory) not meant to take things like clothes, childs toys etc...

    Wild Duck, are you sure you're getting the full story from your brother?
    It's not too unusual for people to have buried their head in the sand, ignored warning letters and deadlines, then pass on half the story to others.
  • Brother has failed to pay any mortgage and has been turfed out of house.

    Repossession company (bank or mortgager) had then cleared house ready for new owner. This would be Bank Of Ireland and NOT bailiffs and is standard in event of mortgage default

    As everyone has stated, sounds like brother has ignored months of warnings about failure to pay mortgage and has now suffered because of his stupidity - what a doofus!

  • This story should be lesson to those in financial difficulty about how important it is to keep up payments on your mortgage - and to communicate with your bank and try to work things out (rather than bury your head in the sand) if you've having problems.

    A bailiff supervised the contractors sent by BOI,this information came from the estate agent dealing with the resale.

    Person out walking sees a "BEWARE, OPEN MINESHAFT AHEAD" and carries on walking without changing direction. Climbs over a wire fence, scales a wall with barbed wire on top. Wrenches opens a door in hoarding around mineshaft with final warning sign and proceeds to fall down the shaft

    Now lying at bottom of shaft shouting:
    "I HAVE FALLED DOWN THIS SHAFT"

    Your doofus brother has ignored months of messages from BOI telling him that he is defaulting on his mortgage. A court case where the house repossession was arranged with BOI seems to have been overlooked and so on.

    Umpteen stages to either prevent repossession or at least arrange to clear the house. Some people just cannot be helped and I suggest that you get another brother....
