So basically he is just digging in his heels and refusing to sell to keep the roof over his head but keeping you tied up to the mortgage.
  • Pretty much to be fair and I don't think I can cope with the whole dragging him through solicitor route.

Unfortunately it looks like you will have to do just that. If he defaults on the payments you are going to be affected and however can you move on otherwise.
  • I'm just trapped pretty much!

So this has been going on for 4 years !!!!!
Get to a solicitor, that's ludicrous, you are being taken for a right mug.
  • Pretty much and when I mentioned solicitor before he said he would stop paying mortgage and let it get repossessed! Nice guy isn't he!

Hes trying to hold you to ransom over it by the sound of things. Get to a solicitors, get advice making sure you point out you want this to end up in your best possible interest, not just to walk away from, and let your ex wallow in the hole he has dug himself.

If you don't want any money from it can you just get the mortgage switched over to his name so he has sole responsibility. Or is his income not sufficient to cover it?
Remember the saying: if it looks too good to be true it almost certainly is.
