    I really feel for you and your sister OP, for what you've had to go through, and for so long.

    Re proof that the sister lives there, if there are some neighbours who know that she lives there, wouldn't the council take their witness statements as proof? That's if any of them would do that.

    I'm on a pre-payment meter and the company (EDF) send me quartely statements showing my useage. Could you not ask for something similar from your supplier or is it in your name too and not your sisters?

    Although if the Local Authority has accepted the brother an an appointee for his sister then he can appeal and his appeal will be treated as his sisters appeal.

    However I am a little confused can I make an appeal on behalf of my sister or not ? the council state no. One of your comments state no yet the housing officer takes a different view and refers to p58
    chapter 5.7 the guide to housing benefit by Sam Lister and Martin Ward in which they appear to disagree and say yes I have read these articles with great interest my only concern is this just a GUIDE and not legally binding ??
    For the avoidance of any doubt I have now made a new appeal in my sisters name may be I should appeal against the previous appeal not been accepted The council will have taken advise and have high lighted NON_DEPENDENT can act
    THE ELECTRIC BILL which the council keep on insisting for
    my sister received a text from NPOWER they gave an account
    number and stated if we rang them quoted the account number
    they would send out a bill/statement
    GREAT AT LAST I rang the number they supplied my enthusiasm
    was short lived I was passed from dept to dept only to be cut off half an hour later I was informed a new account has to be set up and could take up to four weeks as they are changing accounts
    and could not send out a statement
    Our local MP who is also the local Councillor is in the area on the 21st Sept hopefully we will get an appointment
  • Ask the council if they consider you an appointee if they say yes - direct them to the guidance.
