Walked out of job - how long till benifits are sorted?

Hiya,

My BIL has walked out on his job and my sister is worried that they will unable to pay bills untill all the benifits are sorted out... j/w are they pretty fast at doing this sort of stuff?

She owes 3k to child tax credits so still hoping they will pay her something although atm she was paying them £30 a month. They have a 5 year old child.

They have no savings so she is worried about the up coming bills to when the benifits come through. She earns 800-900 it varys per month after tax.

(Before anyone says anything like he shouldn't of walked out YES he shouldn't off and he's been a complete idiot about it but he has now and nothing I can say is going to change that so no advice is needed in that respect sorry to be blunt. :D)

  • He might not get job seekers depending on why he walked out tbh. Tax credits may increase and if renting they can apply for help with rent and council tax asap

  • Btw I won't judge as my husband had to quit his job with nothing else to go to as it was affecting his health.

    Yea they are renting.

Their is no geniune reason he got into a fight with his boss over nothing and he walked out, boss said if he walked out he couldn't come back... he is now expecting them to come begging for him to come back to work because he is 'the best worker' and everyone else is lazy... -_____-

He is a car cleaner. (Not that thats bad but just that their not exactly irreplacable are they.... )

I just didn't want this to turn into a thread like 'he should do this' as its not my place to tell him what he should be doing and as said its to late now its done.

He needs to start looking for alternative work urgently; he could be sanctioned for upto 6 months for leaving a job.

As she is working, she needs to make a joint application for CTB and LHA/MIA urgently, plus tax credits if they are available.

If he is rejected for JSA contributions based, he may not get hardship payments given her income.

Suggest they go over to the MoneySaving Forum for ideas on very low cost living and that he sorts out and sell anything that he can through e-bay, amazon, car boots etc.

I know you are not wanting to hear about the aspect of his walking out but, to be honest, he is going to have to get this sorted out if he wants to claim contribution based JSA.

At the moment he has neither been dismissed or has resigned.

Often the boss/employee shouting out things during an argument ('get out', 'I'm leaving and not coming back') is said in the heat of the moment and does not, as said, count as a dismissal or a resignation.

These things have to be done properly. There is also a question of pay in lieu of notice and holiday pay that he needs to be concerned about. He shouldn't miss out on this extra money.

I expect he is feeling angry at the moment but if you can remind him of his 'rights' regarding dismissal (google for more information) then he might consider his next step before automatically thinking 'what benefits am I entitled to'.

He's not interested in looking for work. He's going to be a stay at home Dad and do the ironing and look after his child..who is at school full time ofc. total sense.

Not for me to get invovled in that aspect.

To above poster, as far as I am aware he is going back into work today to pick up his P45...I guess the rest will get sorted with it.

  • Did you see the bit about him not getting money for 6 months?

Also if he's not looking for work he won't get anything.

Is that just JSA though? I am guessing since he is not planning on looking for work he will be wanting HB + tax credits etc which goes back to the orignal question of once applyed, how long does it take to actally start coming through.

Sorry if I seem abit blunt but I am worried for my sister not him, he has caused her nothing but trouble tbh and I'm 99% sure she wouldn't still be with him if it wasn't for the child/childcare aspect as she works fully flexible hours.

He can 'want' the moon, he'll only get what he is entitled to and does the correct things for.

HB without JSA will be difficult, and it will also take into account his girlfriends wages. She may be earning enough to keep them in the eyes of the council.

Tax credits, well you've already said they owe them 3k so that won't go away. Depends on how many hours she/he is/was working. He won't get working tax as he's not working.

Has he actually applied/been awarded any of these things? As for how long, how long is a piece of string. My last experience of JSA took around 2.5 weeks, but I was actually looking for work and hadn't walked out of a job.

Long ago when my partner at the time earned 900 we were entitled to no HB, no CT, nothing. We did not have a child though so they may be entitled to a little bit, but not a lot.

I suggest he gives up on the idea of being a stay at home ironer and go either grovel for his job back or get another.

They are both working around 40-50 hours, although my sisters job is actally a zero hour contract but I don't think shes ever done less then 30 hours.

He was earning about £1500 after tax.... I was abit worried because he would of already earnt about 6 months pay this year (so thats what £9000?) it would affect his tax credits as that puts them around 20k+ for the year total I would think depends how they view it....

He hasnt applyed for anything yet as he still thinks they are going to come begging....I think today is D day when he will actally realise they arent but then he has it in his head he doesn't 'need' this job and will go on benefits. End day he needs to go in their and apolgies and get his job back but he is stubborn and wouldn't do that. He will only go back if his boss actally says please come back... -.-
