Debt managers ltd claiming I owe!!!

Hi all, on Tuesday I got a call early morning asking my name address and date of birth, I said "holding who's calling?" Debt managers services ltd, I stopped her there and said all contact via mail please, she agreed, Thursday another call which I ignored.

Friday 2 letters arrived from this company, one stated my ref and their ref and a reference to Barclays, an amount of £992 and a heading UNAUTHORISED DEBIT/CREDIT CARD PAYMENT.
It stated my automated payment had not gone through etc... Please call to discuss payments with new card, the 2nd letter dated same as first headed DEFAULT NOTICE, stated my £12 repayment agreement was not kept up to date and I should call them.

I do bank with Barclays but do not pay anyone £12 a month on any repayment plan.

I recently got a new debit card as chip broke in other. I can't think what or who I pay £12 to and have checked statements, I will check with bank Monday morning also.

For now I have sent this letter which was a template on this forum
prove it letter.
It won't allow me to paste a link.

Is this the right approach to such a letter.

Best regards

How on earth can they know my address and name?
Years ago I got into debt but I repay my creditors each month by standing orders!

Oh to be debt free eh!!
  • Hi

Maybe electoral role, debt trace on your credit report?

Maybe they bought one of your debts you are paying?

Prove it letter will find out what they have.

Yeh I guess, however I do not have an arrangement with any creditor for a £12 monthly payment on a debit card!

If they were to ignore my letter which I'm sending recorded delivery I take it there is another letter in the chain I would send.

  • TBH, if they ignore your reasonable request for proof but continue to demand payment, formal written complaint time. Also report to OFT as they will have broken these:
    http://www.oft.gov.uk/shared_oft/consultations/OFT664Rev_Debt_collection_g1.pdf

These say what they can and cannot do.

Any ignoring of complaints can be referred to FOS after 8 weeks.

Ok thanks, 66 pages of small print but I see what you say, what is FOS and I guess 8 weeks is an official amount of times within guidelines.

  • FOS link:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

Basically, if a bank or DCA fobs you off or ignores you then the FOS get involved on request to try and resolve. Free for you, £500 per case for the bank. Hence DCAs would hate this being referred.

You have to go through bank or DCA complaint procedure and they have 8 weeks to give you their final response or you can refer

Worth a read, so when these or others don't play fair, you can complain and make their life difficult also.
