Spify, I appreciate that this is water under the bridge now, but it is worth knowing your rights for the future. Once your fixed rental contract came to an end you automatically moved onto a rolling tenancy. You had as many rights under this as you did previously. although it depends on the frequency of your rent payments, it is likely that you were entitled to at least 2 months notice from your landlord (assuming that you were paying rent monthly). Even then, you could only be made to leave once your landlord had applied for a court order.
Unfortunately, if people leave before the bailiffs arrive, councils tend to class this as being deliberately homeless and are not obliged to offer help
I hope that you are able to get something sorted out soon. Have you seen a doctor for help with your depression?0 -
For some reason I can't get on on my previous account but I thought I would let you know what happened. I went down to the JCP at 9am on Monday and phoned through to Benefit Inquiries. They gave me the same generic response and said they would look into it and I should call back later.
I went straight up to the Welcome Desk and explained my situation to one of the guys there. He took my details and said he would look into it. He had a look and said there was a note on my info but he didn't like the fact that I had been run around Thursday and Friday and said he would bring it up with his Inquiries guy but he was currently with someone so I would have to wait for an hour.
I waited and was then told Inquiries would look into it and I would need to come back at 12:15. No point me going home as I would have got home only to come back so took a stroll and waited. Got back at 11:45 and the guy told me that my Tenancy Agreement has not been received at all and I will need to bring it in and they will scan it and send it straight over. By the time I got back it was almost 2pm. Gave in my tenancy agreement and it was sent over. By now there was no point going home again as I had to speak to my advisor at 3.30pm. By the time I left at 4pm I was still waiting on a reply but told to come back the next day after 10am as nothing could be done now.
Fortunately I had a work experience interview just down the road from the JCP at 10:30am so went in straight after. I spoke to the same guy again and he immediately went to see what was going on. I was told to take a seat and they would call me if anything happened. At this point I was close to refusing to leave until the matter had been sorted out. I sat there for a little over an hour and at 11:45am was told the suspension had been lifted and I should receive full payment in the next few hours.
It seems the reason for taking so long is due to misplaced paper work and it is rather suspicious that the paper work that went missing (original letter from my friend and my tenancy agreement) was sent through my advisor. The form I sent through the JCP was received. And my advisor had also told me that they didn't need my tenancy agreement when I gave it to him to report my address changed, even though I insisted that they needed proof of address due to the suspension.0 -
