Am I entitled to JSA?

Hello,

First post, long time reader. I was looking for some advice please.

I recently left my job of 3 years for what I was confident was another job to go to, however this fell through at the last minute. The previous job despite being full time, never gave me any form of contract what so ever, nor do I have anything in writing from the Job I was expecting to move to. I understand that you can not claim JSA if you have left a job at your own will, although wondering if they look at each case on individual merit?

    Yes you can put a claim in.

    They do look at each case on merit. You will be asked to fill in a form explaining why you left your job and put your case forward. The Jobcentre will write to your previous employer and ask them why you left.

    You should get JSA until the decision is made - if the decision is in your favour you will continue to receive JSA. If it's not in your favour you can end up with a sanction on your claim for up to 26 weeks. You can appeal the decision.

    Not that it really matters, however what exactly will they ask my previous employer? All I simply said to them was I am leaving, I believe I have another job, and gave suffice notice (despite never having a contract of any form).

    They will ask why you left.
    It's quite possible your employer will not have cared that you were leaving because you had another job lined up - so diddn't write that down - so they will just report 'resigned'.

    Give all details you can about why you thought you had another job to go to without having anything in writing.
  • Small employer, he will say I resigned. Hopefully when the jobcentre contact him, he will not know what its in regards to (seeking JSA). The embarrassment of leaving and then having nothing to go to... however that's not really important here I guess.

    Try to bring evidence to the Jobcentre interview of the job you thought you hd been given and why it fell through.. a letter from the potential employer perhaps?
  • Unfortunately I do not have any paper work to support the job I assumed I would be moving to. At the same time I have no paperwork from the job I left other than payslips (there was no contract). My previous employer will have no idea why I left, I simply gave notice and no explanation.

    How can you have no evidence that you were offered another job? Don't you have a letter or email to confirm that you were successful at the interview? Don't you have the name of the person who said he/she was given you the job so they can contact them? A copy of the advertisement of the job, of the letter you supplied with your cv etc... Coming up with nothing at all is going to look extremely suspicious.

    You left the security of a full time Job which you had for Three years, for a new employer who hadn't even bothered to confirm the Job offer along with details of your working hours & salary to you in writing?

  • To be fair to the OP these things can happen when working for 1 man owned small firms, albeit it's never an ideal work situtation. If things like contracts etc are neglected , often other things are being neglected too.

    How he'd go about proving what has happened to the Job Centre is another matter. Unless someone in the new firm is willing to put in writing a firm job offer was made but fell through at the last minute.
