There are no fixed rules - the 2/3 night "rule" is a very common urban myth.

Financial links are the one of the biggest factors that the Decision Maker would look at (do you have any joint accounts? who pays the household bills? is he registered at this address for anything at all?).. they also look at things like where the person eats, where they do thier laundry and where their possessions are kept.

Are you being investigated regarding this?

Its not an urban myth, if someone claims housing benefit they should live in their home at least 4 days from 7 and Im aware that not everyone does and that theres much more to it when deciding whether someone has a live in partner, but if the OPs bf was living there 6 nights out of 7 as opposed to 3 nights out of 7, it could look as if they are living together and if he was working, could affect her HB and benefits

i see him 2/3 nite aweek if im lucky other then that he has his girl 3/4 ntes a week he has his own house and meant to be moving in by nd of yr but not happening now til new yr due to him losing his job im completely indepenanted dont expect a thing from him i pay my own way etc !!!!!!!!!!

But you are still seeing him, if its not working for you, its better to try and sort things out, irrespective of whats going on with this claim of him living with you or not living with you.

If he is such a loser why don't you dump him?

Living on benefits isn't paying your own way, it is being dependent on the state not independent.

Obviously yes do they look at the number of days/nights spent there but there's no specific number in the IS rules, its one of a many things they look at.

Havent got a clue what the housing benefit rules are but thats not what the o/p asked about because she lives in the 7 nights a week anyway

yes i was reported by an old neighbour end of last yr saying he lived at my hosue hes doesnt, he stayed 2/3 nites aweek, i was reported 2 yrs ao for same thing lady seemed veyr happy when i made my statement that he has his own house etc, nothing has changed, ive just moved to bigger house so he can move in by end of yr but may not happen til new yr now as he was made redunant and looking for new job so he can make the move etc

If they previously decided you weren't living together as husband and wife, and genuinely nothing has changed since, they'll probably decide the same again.
  • Lots of oxymorons there!

If he has the child 3/4 nights per week then why should he put his hand in his pocket, you get all the child benefits!

I may have misunderstood then - I thought that the OP meant he had another partner that he is with for the rest of the week
