Did you tell the insurance company that you had a pending prosecution for no insurance?

Your licence consists of two documents - the photocard and the paper counterpart. If you only present one of them you have it presented your licence.

Unfortunately that's completely wrong - you must produce both parts of your licence at the police station. It actually states this on the top of the counterpart. Turn up with only one part and you'll be sent home to get the other.

The officer / civilian station officer will fill out a standard form when he/she takes your licence. On it, there is space for any further offences. The expired licence will be noted there and it'll be up to the admin unit as to whether the offence will be followed up.

Oops - damn predictive text! It should have said "If you only present one of them you have not presented your licence." Now fixed.

The offence was on Sunday and I'm going to the police station tomorrow with my photo I'd and counter part .
Do I play dumb and pretend I didn't know it had expired ?

Expired photocard licences are produced every day, I have never known anyone take action other than advising the person to get it sent off.

You will be fine, it isn't a fixed penalty offence and authority to prosecute comes from DVLA, eventually as a cash earner the DVLA may send automatic fines out to people who fail to renew, just like an expired tax disc, however, at present there are no plans, let us know how you get on, but you will be fine

The whole licence thing has become a complete farce.

My son was pulled over by the police and told his licence had been revoked by DVLA - first he knew about it ! His vehicle was impounded despite his protests - the "computer" was always correct he was told.
When DVLA admitted that they had made a ****- up, the police wouldn't release his vehicle until he had a new plastic/paper licence - even though the "computer" has been updated by DVLA

I only have the photo' id licence. When I had to notify them of a change of address, I was told to send a photo' and my almost in pieces paper one. And all I got back was the plastic photo id one.

Have you told the new insurance company about the points? If not, expect a cancelled policy and double your current quotes due to the cancellation (plus the massive increase for the IN conviction).
  • media coverage on this one last year IIRC, police wrongly handing out points and fine for photocard expirery wrongly believing it made the counterpart of the license invalid! wich is not true.

the only time the police can hand out a fine is when the DVLA revoke or your suspended or banned from holding a uk driving license wich then inturn makes the offence driving without or inaccordance of a valid driving license.

if the civvy clerk kicks up about your expired photocard ask to speak with the duty seargent to clarify (as all police stations by now will have been reminded that an expired photocard does not make your driving license invalid).
