Have to present expired driving licence to the police - will I be fined?

I got pulled over by police as my insurance expired last month, I have to present my drivers licence at the police station within next 7 days however my driving licence photo expired 3 months ago.

Do you think ill get fined again at the police station ? Anyone else been in same situation ?

Please comment back if you've been in the same situation but yes I know its my fault but just want some advice.

    What exactly has expired.

    Your licence can only expire when you reach 70.

    But I take it you mean the photocard is now over the 10 years validity.

    I don't think it's a particularly big deal in itself but along with the insurance expiry problem .... who knows.

    The photo is out of date. I need to go to the police to give them my licence so they can put the points on but I dunno whether they'll see its out of date and let it go or whether they'll add more points/fine on it.

    I'm not for one moment suggesting you lie to the police - but isn't it the paper bit that gets sent away to have the conviction recorded on it.

    I would get a renewal form and have it all filled in ready to send to Swansea and innocently ask what to do first.

    When did the insurance offence take place? Was there a court case?

    That could well have been a good reason for not sending away the application before knowing the result.

    Was your licence valid at the time the insurance offence was detected?

    The average police officer does not want to take on extra paperwork - far from it - and a photocard needing to be renewed is pretty small beer compared to having no insurance.

    The police cannot fine you for failing to update your photocard as it's not a fixed penalty offence. All they could do would be to summons you to court. If they did it would be a small fine and no points. As it's a minor issue it's unlikely they'd do this unless they were going to summons you anyway.

    My worry would be that the bloke at the desk might think that you can't accept a fixed penalty for no insurance with an expired photocard - and he might even be right, as I don't think it should affect the fixed penalty, but I'm not 100% sure. If he didn't accept it then you could find yourself in court for no insurance and potentially facing more than 6 points and a bigger fine than £200/300.
  • I got fined £300 and 6 points , I now have I insurance as I had to get some to release the car from compound.
    The offence was on Sunday and I'm going to the police station tomorrow with my photo I'd and counter part .
    Do I play dumb and pretend I didn't know it had expired ?

    An expired photo is not an endorseable offence so you can't get points, the fine is up to £1000 though.

    Not sure how much people are actually being fined if at all but there's no point lying about it.

    i see cars pulled over from time to time. people probably living in the brink, driving bangers and got caught driving without insurance. Many times i've seen police slap on big yellow police seizure stickers for I presume driving without insurance. You are lucky to get away with just points without your car taken away from you too.

    The plastic card you carry is just a quick identification but does not show endorsements etc. It is not your actual licence.

    Your true licence is the paper document that most people keep at home and it is that which you have to submit to a court when asked to produce your licence.

    Why not offer the paper one to the police when you go and hope that they accept just that?

    Keep the plastic one in your pocket and only present it if they specifically ask for it.

    Your licence consists of two documents - the photocard and the paper counterpart. If you only present one of them you have not presented your licence.
