Where do I stand with the furniture store..

Hiya guys..
I went into a well know furniture store over the weekend and ordered a new sofa, it should have been £1600 but the guy doing all the paperwork made a mistake adding it all up and has undercharged us..
We paid them the deposit (which they took) and he set up 2 years interest free credit with a finance company for 2 years which was accepted and we left with the paperwork however this morning my husband received a call from the guy to say he has made a mistake with his calculations and not charged us enough and wants us to pay the difference..
My husband has said "sorry mate that's your mistake, you done all the working out etc etc, we just signed !!" He told the guy "the contract shows we owe you nothing, but we do owe the finance company, but where do we stand, do they have to honour the contract or do we have to pay ?

    I think that legally you do have to pay, but I am not sure. From a moral viewpoint I think you should pay, otherwise it is a bit underhand. And yes, I have been in a similar situation, and done the decent thing, albeit after a few days thinking. :D By the way, this mistake could cause problems for the salesman and his 'career'.

    As the contract has been agreed by both parties I am not sure they can change it now. Your deposit has been paid and the order placed.

    Out of curiosity how much did he undercharge you by?

    Well, they could just as easily say to you that they cant get the furniture anymore, and cancel the order.

    If you look on your invoice, most of them say E&OE, which means Errors and Omissions Excluded.

    Please OP, just either pay up or cancel the order. Simple as that really then everyone knows where everyone stands.

    If the sale price was advertised and both the purchaser and seller knew the correct price, but the seller then put the wrong price on the invoice, then the contract could be considered void...especially if the purchaser tried to gain from the mistake,.

    Completely different to if the seller advertised it at an incorrect price.

    Thank you for your input, its been really helpful :)

    I did think we may just have to pay but obviously didn't think through the deeper problems for the sales guy etc..
    It was short by £350 so not a snip. I've looked and it does have a piece that says E & OE's..
    It was 15 mins from closing so maybe he was tired but looking at the paperwork he has rather than add the insurance, delivery on he's added that to the "correct" discounts and then deducted it all, on the invoice it shows as " shop discount"

    Just on a moral basis you should double-check with the store. Perhaps they'll just be so astounded by your honesty that they'll keep things as they are.

    One day you might be in a position where someone could take advantage of you and you'd hope that the person would do the right thing too!

    Another point, some years back I bought some slide film ata good price by cheque and mail order. A month later I got a duplicate order. So I placed another order, and again received double what I had paid for Not long after the shop went bust. I regret not having told them of their error, clearly a faulty system. No doubt jobs were lost, and innocent people lost their own money.

    If you are happy with the price I would explain this. These things are massively overcharged. There is no loss on their end.

  • I have rung the store today but no one seemed to know what I was talking about which was slightly odd ??
    However I will give you all an update as soon as it sorted to let you know the outcome :-)
