Advice re faulty tent from Millets

    Your right to cancel qualifying contracts under the Distance Selling Regulations is unconditional. They could camp in it every day for the whole 7 working day period and still cancel on the last day.

    Of course if the tent is damaged or misused the company could try and sue the buyer, and I think new changes due to be enacted by next year may give the company the right to deduct from the refund if the item is not saleable.

    However my understanding of the OP was that the tent was assembled for test purposes only.

    Following that I imagine you cancelled for a refund.

    Anyway, I would be writing to them stating that you reject the goods under SoGA simply because they do not conform to contract. State that you expect a full refund within 14 days, as you have already waited some time.

    I asked on 19th if they would be sending a replacement out, they told me they couldn't send a replacement until they had received it back in their warehouse so I told them the best thing to do would be to refund me. They said as soon as they could track they would refund. I got really annoyed and said they could track to refund but not to replace the tent at which point they said they had none in stock to replace.

    Three cancelled weekends since delivery on 12/8? Do you need a calendar to work out that the OP is 'laying it on'? 'Think of the children' is far too often a sympathy card.

    I think you might be mistaken.

    The OP mentioned delayed delivery accounted for some of the cancelled camping trips.

    I didn't post on here to be criticised. I ordered the tent on August 6th with free next day delivery hoping for it to arrive in time for a camping trip that weekend, by the Thursday, it had still not been dispatched. It was finally dispatched on the Friday and arrived on 12th. Weather wet all week, took until 18th to be able to assemble tent, so no camping that weekend either, tent returned on 19th so no camping this weekend either. Three camping weekends.

    Please do not comment if you can't help.

    You need to carry on reading after the word delivery in the OP. they blame both the delay in delivery AND the fault for the cancelled camping trips.
