  • Anyway in the eyes of the council or whoever would be looking at it, you have a house. You want to give away that house, and then claim housing benefits to pay rent on that house. Its plain why that looks suspect.

    Prevented by law from paying Housing Benefit for 5 years where the tenant previously owned the property.

    After 5 years we would then look as to why they sold their property, what happened to the equity, if there has been a commercial non contrived tenancy for the previous 5 years with evidence of monthly rental payments.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    The only option you have is to either find a way of paying the mortgage yourself or to move out.

    You will not get benefits on that property. Theres really nothing much more to it.

    The two options I gave are really your mums only way to help with you staying in that property. Right now youre basically asking the taxpayer to pay your mum back the money you have lent from her.

    Could you and your mother enter into a formal agreement through a solicitor for her to repay the balance of the mortgage against an agreement for you to repay her the money already owed and the mortgage repayment plus interest at a rate you can afford?

    Maybe you could try posting on the debt free wannae board(think that's the correct one) on ways to try your out goings. Just a thought
