Housing Benefit query

    Housing Benefit won't pay whatever way you do the tenancy as you were previous owners.

    Yes as we borrowed the money from my mum to pay off some of the mortgage

    so under no circumstances will my mum be able to buy our house and let it to us and us get help even though my husband has been signed off of work due to illness :(

    No.

    The equity in the property you will be seen as giving that money to your mum (because you um, have...) and will be treated as if you had that money, so any means tested benefits will stop because you had a home (disregarded for capital) but then sold it and now have no home and no money to show for it...

    Do you really think you can just 'give away' a house and get benefits because he's signed off sick?

    How many bedrooms in the property and how many people occupying?

    Lodgers may be a way for additional income. Or moving in with your Mum and renting it out.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    Getting a job now your husband's at home to look after the children could also be a way forward.

    Is there a possibility that you could sell the house, pay back all you owe to your Mother, clear mortgage, and then rent privately.

    You would be able to claim HB & CT benefits which might help your situation.

    I'm not giving away my house, i owe my mum SO much money thats the only way i can pay her back.

    I have never claimed anything before and we are really struggling as next in line its more than likely to loose his job.

    I am just trying to look into all of the options.

    The last thing we want to do is move out as my husband struggles with change and we are really settled here.
    Its only a 2 bed with us and our 2 children so no option for lodgers

    As you are in sure dire straits right now, and your mum clearly has money if she can afford to pay off your mortgage, why doesnt she a) pay off your mortgage for you and allow to repay her when you are on your feet, or b) let you off paying her back the money you owe her until you are on your feet.

    no official loan but you can see the money going out of my account and into her account each month

    yes we would be paying extra to her each month

    yes i can see it looks like that, but its the truth :o

    my mum is not like that and as it is not clear right now when my husband will be fit to be able to go back to work i cannot guarentee when we would be able to pay her back
