ESA Appeal Timescale

How long does it roughly take on average?

And will I continue to get the same rate of benefit I get now on IB until it's sorted out?

    What stage of the process are you at?

    Yes you will continue to get your IB until settled and if sucessful your ESA will be the same amount.
    Lost my soulmate so life is empty.

    Thanks I was worried because it says you will only get the ESA assessment rate but is that only for new claimants only?

    I get IB + Income Support top up, that will stay the same while I appeal according to you, yeah?

    That's why I asked what stage you are at. Did you fail to get the necessary 15 points at assesement? If so and you are appealing then you will only get the £71 assesement rate and it could be many months before the appeal is heard. Also you need to send in fit-notes during the appeal process.

    What are fit notes?

    You think I'm looking towards Christmas time before my appeal is heard?

    apparently they are backlogged alot with appeals.

    Fit-notes are what you get from your GP and were known as sick notes before.

    It would more likely be well into next year before your appeal is heard, mine was 10 months! Many have been even longer.

    If you failed your assessment you will need to appeal & get sicknote from a doctor from the date your IB ended.
    You will get ESA reduced rate on appeal. which can take 13 - 14 months but can take as little as 4 months. If it takes less than 6 months and you lose the appeal, it can hinder a new claim to ESA, so you actually want it to take more than 6 months.

    If you have passed the assessment onto ESA WRAG then you will get your full IB/IS rate while you appeal for Support Group no need for sick notes

    Hi Roxy,
    As far as I see you haven't said at what stage you are in your appeal i.e. You applied for ESA TO TRANSFER FROM IB? Were you turned down completely for ESA or were you placed in WRAG and are appealing to be placed in Support Group?? Which of the above?

    I was transferred from IB to ESA in October last year and was placed in WRAG. I requested a copy of the 'medical Report' they wrote which resulted in their decision. As there were many discrepancies in the report and false information I wrote to them to request a reconsideration. I received a letter within 4 weeks with a reconsideration to be placed in Support group. I did not have to go to tribunal as they overturned their original decision based on my letter of appeal .

    With regard 'fit notes' from GP, I didn't send any of these as I did not need to as I was on IB and applied to transfer to ESA.

    My ESA appeal has taken 14 months, I have received no money during this time...hope it's different for you
