We are in this position as well but my partner only worked there two years on the shop floor at a low wage so we wouldn't be in for a large windfall! We are disgusted with their response I don't see how they can discriminate / alienate a certain category, pay the other half what they are owed and leave the other half empty handed.0

We will be appealing the decision! We will let you know how it goes.0

I am taking them to court over this..I suggest you all do the same0

I worked Thur evening and Sat, Sun and sometimes bank holidays. I also got the same standard reply as others.
To be honest it's very difficult to look at old pay slips and start calculating etc to understand if you were paid correctly or not ..
Any suggestions?
Take them to court, but make sure you correspond with them correctly first..eg You must do a 'before action' letter and get your claim in asap...you are too late to go to tribunal, so use the small claims court...I hope many others do the same.0 -
how would you know how much to claim for? would they calculate how much you are owed so that you can take them to court? How long would you have had to be left before ACAS arent interested?0

Just found this thread, I worked for JLP from 2009-2011 contracted to Sundays, I actually came in and worked on all my holidays as I couldn't afford to lose the time and a half premium. I worked FT hours mostly (as OT) but they would never contract me to more than 12 hours a week. They also were very sneaky about ensuring I never received time and a half for going over 39 hours a week. Has anyone made any progress with this?0

they are going to be swamped with claims by the looks of it....Do it with MCOL. It is quick and straightforward...They have till 22nd (tomorrow) to respond or I ask for a judgement, then no court case, but do take the advice of a solicitor if possible...I got him to write to them explaining my case and then a pre-action letter...Still only got the standard reply as you all0

I doubt they will respond, let it eek out and then pay those that make the claim. A large % won't bother and they will save themselves the moneyDon't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0
