    In theory you can buy a laptop with Windows 8 and claim a refund for the Windows 8 licence if you uninstall it. Then use that money to buy a Windows 7 licence.

    Long-winded route but possible.

    OP wants XP mode.

    XP mode is just a VM, it wasn't anywhere near as well implemented as Microsoft initially claimed it would be in terms of integration and given the OP's post implies they're not very technical, I'm not sure the XP mode will be of use to them. It is possible to run it under Windows 8 including migrating the XP license.

    You'd need to go out and buy an extra XP licence to do that in Windows 8.

    XP Mode within Windows 7 (as long as you get the right version) doesn't need the extra licence.

    You are mad if you think that you will get a refund that will reflect the price of a Windows 7 Professional or Ultimate licence. :)

    Just use W8 and bung Classic Shell on it. There is nothing major wrong with W8 that the 8.1 update won't fix in a month or so. That will put the Start screen back on, which is what most people miss the most.
    No free lunch, and no free laptop ;)

    The OP wants to run XP programs via XP Mode.

    Windows 7 and 8 both have compatibility mode for older programs, just select in the properties

    Indeed, but not everything will work. XP Mode just give another layer of possibilities.
