What are our rights and what do i do now!
You will be glad to know. Every motorway has now been shut, as you never named the highway.
Forensic teams are now combing the carriageways to find the perpetrator.
My money would be on Travis Perkins.
For no other reason it was lunchtime and they parked in the fast lane of the M25.
Apparently that's ok, because 75% of the fast lane is closed by them at any given time.
They just had not reached the closed bit, but it would of been closed within the hour, so counts0 -

So you smash into something on a road, that damages the vehicle, but don't seem fit to pull over and examine what happened?
The oil cooler was damaged in this collision, but that had no effect on the vehicle until you got home? When you viewed the damage?
And you didn't report to Police, that debris in a carriageway that had damaged your vehicle was there, or reported in any way?
You just carried on? So that someone else might have a further accident due to this debris?
And you want to find out who to sue?
Last time I checked, it's illegal to not inform the Police of a RTC, be it a dog, person, whatever, therefore posting on a forum, you have broken the law.
Unfortunately it isn't classed as an RTC, it doesn't fit the criteria as a reportable accident, just amazed that people believe the highways authority will sit and scan hours of video for an insecure load
Also the cameras unless monitored and operated manually, i.e zoom etc, will only show cars, lorries etc, they dont pick up reg No's this is done by the ANPR cameras on the motorways.0 -

Utter bull.
A reportable rtc is damage other than to your own vehicle.
But when your study for you theory test in C few years time you'll realise that.0 -

1) Contact the police with the part. Loose / dangerous loads are an offence.
2) Contact the company with a photo of damage, a photo of the part, and 3 quotes. or your insurance company.
3) Expect that you or your insurance company will have to pay because you can't prove that the offending item fell off one of thier trucks.
(Although the police might find a missing piece and forward you the details - which means in a small claims court you have a reasonable case that on balance the item fell off thier truck)
4) Thank yourself lucky that you are all safe and well, and that you didn't swerve and end up upside down in a ditch, after spinning 3 times. (That happened to a mate 3 weeks after passing his test. He was uninjured, but his G/F finished with him as a result of his bad driving)0 -

Forgive me if this sounds harsh, but I'm having trouble understanding how on earth you think the company name on the fascia is in any way responsible.
Let's say I sell an item with my name on, and the buyer throws it through someone's windscreen. Does that make me responsible as it had my name on it? Of course not, that would be silly.
Common sense needs to be used in this instance. You have rights against whoever left it there, but you can't prove it. Best get the wallet out.0 -

I just ran over a brick in the carriageway, it had London Bricks printed into the brick? really pleased now I have identified the owner and the culprit, I will let you know how I get on in suing them ; )0

This is great news - I had a puncture last week - caused by a GKN nail.
I had to get a new tyre as it was unrepairable.
I'm going to sue Nigel Stein - the CEO of GKN - as it's obviously his fault.
I'll let you know how I get on.0 -
